Creator Policy
Creator eligibility, content rules, monetisation, valid views, payouts, and enforcement.
On this page 29 sections
1. Purpose and Scope
Which means: This policy explains what creators can and cannot do on Burbn, how creator verification works, how creator content may be used, and how Burbn handles creator safety, monetization, product promotion, and enforcement.
- This Creator Policy ("Policy") applies to all creators, influencers, streamers, affiliates, product reviewers, style publishers, scroll uploaders, live sellers, product taggers, brand collaborators, agencies, and any person or entity using creator tools on Burbn ("Creators").
- This Policy applies to all creator activity on Burbn, including uploaded videos, scrolls, styles, captions, hashtags, comments, live streams, product tags, group-buy promotions, affiliate links, profile content, chats, offers, reviews, brand collaborations, paid promotions, and any other content or conduct made available through Burbn ("Creator Content").
- This Policy forms part of Burbn's Terms of Service, Community Guidelines, Privacy Policy, Merchant Agreement where applicable, and any campaign, affiliate, monetization, or product-specific terms made available to you.
- If there is a conflict between this Policy and a program-specific agreement signed by Burbn and a Creator, the program-specific agreement controls only for that program and only to the extent of the conflict.
- Burbn may update this Policy from time to time. Continued use of creator tools after an update means you accept the updated Policy.
1.1 Key Definitions
- "Creator" means a registered Burbn user who uploads, publishes, promotes, reviews, tags, demonstrates, streams, or otherwise distributes content on Burbn, whether or not the Creator is currently eligible for monetization.
- "Monetized Creator" means a Creator who has been accepted into a Burbn monetization, campaign, affiliate, rewards, or incentive program and remains in good standing.
- "Valid View" means a view that satisfies Burbn's technical, behavioral, authenticity, watch-time, account-quality, and policy criteria for creator monetization.
- "Invalid Traffic" means any view, click, follow, referral, order, impression, save, share, review, message, or other activity that is artificial, automated, duplicated, incentivized improperly, manipulated, fraudulent, or not generated by genuine user interest.
- "Earnings" means the amount credited to a Creator under an eligible monetization program after Burbn applies validation, reconciliation, fraud review, returns, refunds, taxes, payout rules, and any program-specific adjustments.
- "Follower" means a Burbn user who follows a Creator through a legitimate interaction and is not a duplicate, bot, fake, purchased, coordinated, or otherwise invalid account.
- "Guardian" means a legally recognized parent or adult guardian who is authorized to consent to a minor Creator's permitted participation and accept responsibility for the minor Creator's obligations.
- "Program Terms" means any additional terms, dashboard notices, campaign briefs, payout rules, creator program pages, brand instructions, seller instructions, or written agreements that apply to a specific creator program.
2. Creator Eligibility
Which means: Creator access is not automatic. You must be eligible, truthful about who you are, and able to legally participate in creator and commerce activity.
- You must maintain an active Burbn account in good standing and comply with this Policy, the Terms of Service, Community Guidelines, Privacy Policy, and any applicable Program Terms.
- Unless Burbn states otherwise for a specific program, a Creator must have at least 10 legitimate followers, at least 1,000 valid views, and completed profile verification before becoming eligible for Burbn monetization.
- You must be at least 18 years old, or the age of majority in your jurisdiction, to directly enter paid creator contracts, receive payouts, promote products for compensation, or participate in affiliate, campaign, and monetization programs.
- If you are 13 to 17 years old, you may participate in monetization only where Burbn permits it and only with verified Guardian consent. The Guardian must accept the applicable terms, provide required information, and remain responsible for the minor Creator's legal, financial, tax, fraud, and content obligations.
- Individuals below 13 years of age are not permitted to participate in creator monetization on Burbn.
- You must provide accurate account information, including your legal name, contact details, date of birth, phone number, email address, tax details, payout information, and any other information reasonably requested by Burbn.
- If you act on behalf of a company, agency, talent manager, brand, or another creator, you represent that you have authority to bind that person or entity to this Policy.
- Burbn may approve, reject, pause, limit, or remove creator access at its discretion, including where identity, safety, fraud, compliance, copyright, product quality, or community risk is identified.
- You may not create duplicate creator accounts to avoid enforcement, manipulate metrics, bypass review, evade payment limits, restart a suspended account, or misrepresent your reach, location, engagement, or audience.
3. Creator Onboarding and Verification
Which means: Burbn may verify creators before enabling sensitive features. Verification may use secure third-party verification providers and may require your consent.
- Burbn may require creator verification before enabling monetization, payouts, product promotions, high-volume posting, affiliate links, brand campaigns, live commerce, seller collaborations, or other trust-sensitive features.
- Verification may include phone verification, email verification, account history review, device or risk checks, KYC checks, PAN or identity verification, business verification, payout account checks, tax information, and other checks permitted by applicable law.
- Burbn may use third-party verification partners, including verification providers such as Cashfree, to perform onboarding and identity checks. These providers may process verification requests under their own technical and security systems while acting as Burbn's service provider or independent service provider, as applicable.
- Where a 1-Click Onboarding or similar verification flow is used, the flow may include checking data availability based on a mobile number, initiating an OAuth or consent session, opening a verification SDK, collecting your consent, receiving an authorization response, generating a limited-time access token, and fetching permitted user details after consent.
- Verification sessions may use identifiers such as a session ID, verification ID, authorization code, callback status, access token, or equivalent technical values. These values are used to complete verification and may expire after a limited time.
- Verification status may include outcomes such as successful verification, user closed flow, expired session, missing session information, invalid session information, unavailable data, failed callback, or provider-side error. Burbn may ask you to restart verification if a session expires or fails.
- You must not falsify, alter, forge, borrow, sell, rent, or misuse identity documents, business records, payout details, consent screens, verification codes, or any onboarding information.
- If your verification is rejected, incomplete, expired, inconsistent, high-risk, or under manual review, Burbn may limit creator features until the issue is resolved.
- Completion of verification does not guarantee creator monetization, campaign eligibility, audience distribution, product visibility, payout approval, or continued account access.
4. Account Security and Profile Accuracy
Which means: You are responsible for your creator account, your profile, and all activity performed through your account.
- You must keep your login credentials, device access, verification codes, payout credentials, and account recovery methods secure.
- You are responsible for all creator activity performed through your account, including posts, chats, product tags, affiliate promotions, live sessions, offers, collaborations, and account settings.
- Your profile must not impersonate another person, seller, brand, public figure, organization, government body, or Burbn representative.
- You must not use misleading names, badges, profile photos, verification language, titles, or descriptions that falsely imply endorsement, official partnership, certification, or employment by Burbn or another entity.
- You must promptly update account information when your legal name, business details, contact information, payout details, tax information, or representation status changes.
- If you suspect unauthorized access, you must notify Burbn as soon as reasonably possible and take steps to secure your account.
5. Content Ownership and License
Which means: Your original content remains yours, but Burbn needs permission to host, show, distribute, recommend, moderate, improve, and promote it.
- You retain ownership of Creator Content that you own before uploading it to Burbn, subject to the license you grant to Burbn and any rights granted to sellers, brands, collaborators, music licensors, or other third parties.
- You grant Burbn a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, publish, translate, modify for formatting, distribute, recommend, promote, index, analyze, and make available your Creator Content in connection with operating, improving, marketing, and protecting Burbn.
- This license includes the right to show Creator Content in feeds, search results, product pages, seller pages, category pages, ads, emails, notifications, previews, embeds, analytics, moderation tools, and internal review systems.
- You represent that you have all rights required to upload and authorize use of your Creator Content, including rights in video, audio, music, images, text, likeness, products, trademarks, locations, testimonials, and third-party materials.
- You must not upload content that infringes copyright, trademark, publicity rights, privacy rights, design rights, trade secrets, contractual restrictions, platform restrictions, or any other rights of another person or entity.
- Deleting content may remove it from public display, but copies may remain in backups, logs, cached views, legal records, moderation records, analytics, reports, completed transactions, or as otherwise permitted by law and Burbn's policies.
6. Content Standards
Which means: Creator Content must be lawful, safe, honest, respectful, and suitable for a commerce and creator-led discovery platform.
- Creator Content must comply with applicable law, this Policy, the Community Guidelines, product policies, advertising standards, intellectual property laws, consumer protection laws, and any applicable platform or campaign rules.
- You must not upload or promote content that is hateful, violent, sexually exploitative, abusive, harassing, defamatory, fraudulent, deceptive, dangerous, illegal, self-harm encouraging, terrorist, extremist, or otherwise harmful.
- You must not post content that exploits, sexualizes, endangers, bullies, threatens, or targets minors or vulnerable persons.
- You must not publish private or sensitive information about another person without lawful permission, including phone numbers, addresses, financial information, identity documents, private chats, exact live locations, or non-consensual images.
- You must use accurate titles, captions, hashtags, category labels, thumbnails, product tags, and descriptions. Do not use clickbait, hidden keywords, unrelated tags, misleading thumbnails, fake urgency, or manipulative claims.
- Creator Content must not include malware, phishing links, fake login pages, credential collection, suspicious redirects, unauthorized tracking, or attempts to compromise users, sellers, Burbn, or third-party systems.
- Burbn may reduce distribution, add labels, age-gate, remove, demonetize, restrict, or report content that violates this Policy or creates user, seller, legal, payment, logistics, or brand safety risk.
7. Commercial Content and Product Tagging
Which means: If you tag products or influence purchases, you must be accurate, transparent, and careful about what you claim.
- Creators may tag, mention, review, demonstrate, compare, recommend, or promote products only where the content is truthful and not misleading.
- You must not tag unrelated products, substitute one product for another, misstate price, discount, size, material, condition, delivery terms, return eligibility, stock status, warranty, seller identity, or product origin.
- If you receive payment, commission, free products, discounts, gifted items, store credit, sponsorship, affiliate benefit, preferential exposure, or any other material connection, you must clearly disclose that connection in a manner users can understand.
- Disclosures must be placed near the relevant claim and must not be hidden only in profile pages, hashtags, comments, small text, or disappearing formats.
- You must not make claims about health, safety, performance, sustainability, authenticity, resale value, celebrity usage, brand authorization, or regulatory approval unless you have reliable proof and permission to make such claims.
- Product demonstration content must not be edited in a way that materially misrepresents product appearance, color, fit, performance, packaging, size, or results.
- Burbn may remove product tags, reduce content distribution, suspend promotional tools, or require correction where product-related content is inaccurate, unsupported, harmful, or likely to mislead users.
8. Affiliate, Offer, and Group Buy Content
Which means: Promotional tools must be used honestly. You cannot manipulate users, orders, prices, or group-buy participation.
- If Burbn enables affiliate links, creator commissions, make-offer flows, referral rewards, coupon promotions, or group-buy tools, you must use them only as permitted by Burbn and applicable campaign rules.
- You must not create fake orders, fake carts, fake group-buy participants, self-referrals, artificial engagement, duplicate accounts, bot traffic, misleading urgency, false scarcity, or manipulated conversion activity.
- You must not pressure users into purchases using threats, harassment, false deadlines, fake stock warnings, fabricated social proof, or undisclosed incentives.
- You must not promise a discount, group price, refund, cashback, commission, delivery timeline, warranty, or return outcome unless the product page or campaign terms support that promise.
- If a group buy, offer, coupon, affiliate program, or promotional campaign ends, expires, is cancelled, or changes, you must not continue presenting the old benefit as currently available.
- Burbn may reverse commissions, hold payouts, cancel rewards, remove content, terminate program access, or pursue recovery where promotional abuse, fraud, order manipulation, refund abuse, or policy violations are found.
9. Prohibited Creator Conduct
Which means: Do not use creator tools to harm users, sellers, Burbn, or the integrity of the platform.
- You must not buy, sell, rent, or exchange accounts, followers, likes, views, reviews, comments, saves, shares, referrals, group-buy seats, orders, or verification access.
- You must not use bots, scripts, farms, coordinated manipulation, click exchanges, fake engagement groups, spam messages, or automated posting in a way that distorts content performance or user trust.
- You must not solicit users to move transactions off Burbn for the purpose of avoiding platform rules, fees, buyer protections, seller protections, payment review, refunds, or compliance checks.
- You must not interfere with Burbn systems, reverse engineer creator tools, scrape data, bypass rate limits, probe security systems, or use undocumented APIs without permission.
- You must not misuse reporting, appeals, support channels, copyright notices, takedown requests, chargebacks, or dispute processes.
- You must not retaliate against users, sellers, creators, moderators, employees, reviewers, or complainants for reporting content, leaving reviews, refusing collaborations, or enforcing policies.
10. Community Safety and Interactions
Which means: Creators are expected to set the tone for their audience and keep Burbn safe for users, sellers, and other creators.
- You are responsible for your own conduct in posts, comments, chats, live streams, circles, direct messages, collaborations, and other user-facing interactions.
- You must not encourage harassment, dogpiling, brigading, threats, doxxing, review bombing, seller intimidation, or attacks on users, creators, sellers, brands, communities, or protected groups.
- You must not use your audience to manipulate product ratings, seller reputation, marketplace trust, or another creator's standing.
- When hosting live content or interactive content, you must take reasonable steps to avoid unsafe product demonstrations, dangerous challenges, unlawful activity, or harmful audience participation.
- Burbn may limit comments, disable messaging, restrict live features, remove replies, or intervene in creator communities where safety risk is identified.
11. Payments, Rewards, and Taxes
Which means: Creator earnings depend on valid views, genuine engagement, completed verification, payout rules, tax compliance, and Burbn's internal validation. Displayed earnings are not final until Burbn completes reconciliation.
11.1 Program Availability and No Guaranteed Earnings
- Burbn may offer creator monetization features, including commissions, referral rewards, brand campaign payments, bonuses, credits, cashback, affiliate rewards, or other incentives. Availability may vary by account, geography, eligibility, product category, and program rules.
- Creators are not entitled to payment unless the relevant program terms are satisfied, including eligibility, valid tracking, non-fraudulent orders, completed verification, refund windows, cancellation windows, payout minimums, and any review period.
- Any displayed estimate of expected earnings, valid views, impressions, conversion rate, campaign outcome, follower count, reward amount, or payout timing is informational and is not a guarantee of payment.
- Burbn may change, pause, cap, replace, or end any creator monetization program at any time, including payout rates, reward rules, minimum thresholds, eligible categories, and verification requirements.
11.2 Base View Monetization Model
- Where Burbn enables the base view monetization model for an eligible Creator, the standard calculation is: Earnings = (Number of Valid Views / 1,000) x INR 100.
- This model establishes a base rate of INR 100 per 1,000 Valid Views, subject to eligibility, validation, reconciliation, fraud review, payout limits, tax rules, Program Terms, and Burbn's right to modify the program.
- Views that are pending review, later classified as invalid, generated from ineligible content, associated with policy violations, or excluded under Program Terms will not count toward payable earnings.
- Burbn may use different rates for different creator tiers, campaigns, regions, content formats, product categories, traffic sources, seller-funded campaigns, promotional periods, or revenue-aligned programs.
11.3 Valid View Criteria
- For short-form content, a view may qualify only if the content is watched for at least 3 seconds or any higher threshold specified by Burbn for that format.
- For long-form content, a view may qualify only if the user watches at least 10 percent of the content duration or any higher threshold specified by Burbn for that format.
- A Valid View must originate from a real, authenticated, independent user account and must reflect genuine user intent rather than artificial or coordinated activity.
- Views generated by bots, scripts, emulators, click farms, paid traffic rings, forced redirects, auto-refreshing pages, misleading placements, duplicate accounts, self-viewing, engagement swaps, or other manipulation are Invalid Traffic.
- Burbn may evaluate watch time, session quality, retention, user history, device consistency, IP patterns, geographic consistency, account age, behavioral anomalies, content source, referral source, and other trust signals to determine whether a view is valid.
- Burbn's internal analytics systems are the sole source of truth for Valid Views, invalid activity, and creator earnings. External dashboards, screenshots, third-party trackers, public counters, or creator-provided analytics do not control payout calculations.
11.4 Minimum Payout, Reconciliation, and Adjustments
- Unless Burbn states otherwise, a Creator may request withdrawal only after the Creator's eligible payable balance reaches at least INR 200.
- Payments may be processed through UPI, bank transfer, wallet, payout partner, or any other payout channel Burbn supports for the Creator's account and region.
- All earnings may remain subject to a reconciliation and validation period of up to 90 days from the date of accrual, or any longer period required for fraud review, refund windows, chargebacks, campaign settlement, tax compliance, or legal review.
- During reconciliation, Burbn may audit traffic sources, review content compliance, confirm account authenticity, verify payout details, detect invalid activity, adjust earnings, reverse credits, or request additional documents.
- Burbn may hold, adjust, reverse, forfeit, or recover payments where content is removed, an order is cancelled, returned, refunded, disputed, fraudulent, artificially generated, policy-violating, incorrectly tracked, or subject to chargeback, payment partner review, tax review, or legal review.
- If Burbn overpays a Creator or credits earnings by mistake, Burbn may deduct the overpaid amount from future earnings, request repayment, pause withdrawals, or use other lawful recovery methods.
11.5 First 100 Followers Incentive
- Burbn may offer a limited-time promotional incentive of INR 500 when an eligible Creator reaches the Creator's first 100 legitimate followers.
- Followers must be unique, independent, authentic accounts and must demonstrate behavior consistent with genuine user interest.
- Followers identified as bots, duplicates, purchased accounts, self-created accounts, inactive shells, coordinated accounts, or fraudulent accounts will be excluded.
- Burbn may use device and identity clustering, behavioral pattern analysis, account authenticity checks, IP review, engagement quality review, and other fraud controls before approving the incentive.
- This incentive is promotional, discretionary, and temporary. Burbn may modify, suspend, withdraw, cap, or replace it at any time without prior notice.
11.6 Fraud and Abuse Controls
- The following activities are strictly prohibited: artificially inflating views or followers, using bots or scripts, using click farms or paid traffic to manipulate earnings, creating multiple accounts for self-benefit, coordinating metric manipulation, buying followers, selling engagement, or generating fake orders.
- Burbn may use fraud detection systems that include device fingerprinting, IP clustering, watch-time anomaly detection, geographic inconsistency analysis, behavior analytics, account-linking signals, payment-risk signals, and seller or user reports.
- If Burbn detects or reasonably suspects fraud or abuse, Burbn may deduct earnings, reverse credited payouts, withhold funds, pause withdrawals, suspend monetization, remove content, terminate the account, block related accounts, or pursue recovery.
- All enforcement decisions regarding invalid traffic, creator fraud, payout abuse, and reward manipulation are made by Burbn based on its internal systems and review processes.
11.7 Financial Sustainability and Dynamic Adjustments
- Burbn may impose monthly, periodic, creator-level, campaign-level, category-level, or platform-level caps on total creator payouts to protect platform sustainability.
- If aggregate creator payouts exceed Burbn-defined limits, Burbn may proportionally adjust earnings, temporarily modify payout rates, defer payouts, or apply program-specific limits.
- Burbn may introduce tiered payout structures, performance-based incentives, revenue-aligned compensation models, seller-funded pools, category multipliers, or creator-quality multipliers.
- Program changes may apply prospectively or to pending, unreconciled earnings where required to address fraud, abuse, technical errors, legal requirements, or platform sustainability.
11.8 Taxes, KYC, and Payout Compliance
- You are responsible for providing accurate payout details, tax identifiers, KYC information, bank account information, UPI details, and any other documents requested by Burbn or its payout partners.
- Burbn may require PAN, Aadhaar, bank account validation, address information, business documents, Guardian documentation for minor Creators, or other verification before enabling withdrawals or releasing payouts.
- Tax deductions at source, withholding, reporting, or other tax treatment may apply depending on applicable law, earnings amount, statutory thresholds, tax identification, account status, and compliance information provided by you.
- You are responsible for determining and paying any taxes, duties, filings, deductions, withholdings, or reporting obligations that apply to your creator earnings.
- Burbn may deduct, withhold, report, delay, or block payments where required by law, tax rules, payment partner rules, sanctions review, fraud review, or court or government order.
- Failure to complete KYC, provide accurate tax information, resolve payout mismatch issues, or respond to compliance requests may result in delayed, withheld, reversed, or forfeited payments.
12. Claims, Reviews, and Disclosures
Which means: Users should be able to trust that creator opinions, reviews, and recommendations are real and properly disclosed.
- Reviews, ratings, testimonials, comparisons, and endorsements must reflect your genuine experience or a clearly disclosed sponsored or compensated relationship.
- You must not publish fake reviews, paid reviews without disclosure, competitor attacks, copied reviews, AI-generated testimonials presented as real user experience, or reviews based on products you have not reasonably evaluated.
- You must not claim that a product cures, treats, prevents, diagnoses, or guarantees results unless such claim is lawful, substantiated, approved where required, and permitted by Burbn.
- You must disclose if images, results, before-and-after content, try-on content, product demonstrations, or testimonials have been materially edited, staged, filtered, simulated, AI-generated, or otherwise altered in a way that could affect user understanding.
- You must not claim that Burbn, a seller, a brand, or a public figure endorses you or your content unless you have written authorization.
13. Data Protection and Privacy
Which means: Creator features involve user trust. You must protect personal data and use it only for permitted purposes.
- Burbn's collection and use of personal information is governed by the Privacy Policy.
- You must not collect, store, sell, disclose, or misuse user personal information obtained through Burbn, including usernames, addresses, order details, phone numbers, messages, payment information, identity data, or analytics.
- You must not export, scrape, or combine Burbn user data with third-party data for advertising, profiling, retargeting, lookalike audiences, or off-platform solicitation unless Burbn expressly permits it and applicable law allows it.
- If you receive user data for a collaboration, giveaway, seller program, order support, or creator campaign, you must use it only for the purpose for which it was provided and delete it when no longer required.
- Verification data, including information processed through 1-Click onboarding or similar verification flows, must not be misused, shared, sold, or used for purposes unrelated to creator verification, compliance, fraud prevention, or legal obligations.
- You must promptly notify Burbn if you believe user data, creator verification information, payout details, or account credentials have been exposed, lost, misused, or accessed without authorization.
14. Moderation, Takedowns, and Appeals
Which means: Burbn may review and act on creator content, but you may have an opportunity to appeal certain decisions.
- Burbn may use automated systems, human review, user reports, seller reports, payment partner alerts, brand reports, legal notices, and trust and safety signals to review Creator Content and account activity.
- Moderation actions may include warning, labeling, age restriction, reduced distribution, removal, product tag removal, monetization restriction, search restriction, account feature limits, campaign cancellation, payout hold, account suspension, or termination.
- Burbn may remove content without prior notice where it believes content creates legal, safety, fraud, intellectual property, user trust, payment, regulatory, or platform integrity risk.
- You may appeal eligible moderation decisions through the support or appeal channel made available by Burbn. Appeals must include accurate information and must not include threats, forged evidence, or abusive conduct.
- Burbn may preserve removed content, account records, logs, messages, verification records, or transaction information where needed for legal compliance, dispute handling, policy enforcement, user safety, or fraud prevention.
15. Creator Tools and Beta Features
Which means: Creator tools may change, break, launch gradually, or be withdrawn. Do not rely on any feature always being available.
- Burbn may provide creator tools such as video upload, live tools, product tagging, style boards, circles, messaging, analytics, affiliate dashboards, offer tools, group-buy tools, brand collaboration tools, AI-assisted tools, and creator payout tools.
- Creator tools may be experimental, limited, region-specific, invite-only, subject to capacity limits, or dependent on seller, payment, logistics, verification, or third-party partner availability.
- Burbn may change, suspend, remove, or replace creator tools at any time, including features related to upload limits, content categories, monetization, recommendation ranking, analytics, verification, or payouts.
- If you use AI-assisted tools, you remain responsible for the final Creator Content, including accuracy, rights, disclosures, product claims, and policy compliance.
- You must not use beta tools to collect unauthorized data, bypass limits, mislead users, generate unlawful content, or infer confidential platform logic.
16. Suspension and Termination
Which means: Serious or repeated violations can lead to limits, removal from programs, or account termination.
- Burbn may suspend or terminate creator access if you violate this Policy, other Burbn terms, applicable law, campaign rules, payment rules, intellectual property rights, or user safety standards.
- Burbn may immediately restrict access without prior notice for severe violations, suspected fraud, identity abuse, account compromise, child safety risk, violent threats, illegal content, payment abuse, data misuse, or legal compliance risk.
- Suspension may affect content visibility, upload access, live tools, comments, messaging, product tagging, affiliate links, payout eligibility, campaign participation, verification status, and account access.
- Termination does not waive Burbn's rights to recover improper payments, reverse rewards, preserve records, cooperate with legal process, remove content, or enforce surviving obligations.
- You may stop using creator tools at any time, but you remain responsible for prior activity, outstanding disputes, rights you granted, taxes, payments, and policy violations that occurred before deactivation.
17. Legal Terms and Grievances
Which means: This Policy is part of your legal relationship with Burbn. Contact Burbn support for questions, appeals, or grievances.
- This Policy is governed by the same contracting party, governing law, and jurisdiction provisions that apply under the Terms of Service, unless another written agreement with Burbn states otherwise.
- You agree to indemnify and hold Burbn, its affiliates, officers, employees, agents, partners, and service providers harmless from claims arising from your Creator Content, product claims, sponsored content, rights violations, payment fraud, data misuse, tax obligations, user disputes, or breach of this Policy.
- For grievances related to creator content, privacy, account enforcement, or policy interpretation, contact Burbn at support@scrolling.in.
- Burbn may ask for additional details, proof of rights, campaign records, screenshots, verification information, transaction references, or other documents to evaluate a grievance or appeal.
- Nothing in this Policy limits rights or obligations that cannot be limited under applicable law.
- The governing law, arbitration, seat, venue, and forum applicable to this Policy are those stated in the Terms of Service and restated in the Standard Legal Terms below. Indian law applies, the seat of arbitration is Noida, Uttar Pradesh, and the competent courts at Noida exercise supervisory and residual jurisdiction.
- Burbn's liability to a Creator is limited, and warranties are disclaimed, on the terms set out in the Standard Legal Terms below. In particular, the base view monetization rate, minimum payout threshold, and incentive amounts described in Section 11 are programme parameters that Burbn may change under Section 11.1, and no statement of an expected or estimated amount constitutes a warranty or a guarantee of payment.
Standard Legal Terms
The clauses below are common to every Burbn legal document and are stated identically in each of them. They are reproduced here in full so that this Policy can be read and relied upon on its own.
18. Order of Precedence
Which means: If two Burbn documents disagree, this list decides which one wins, so the answer is the same no matter which document you read first.
this Policy forms part of a single set of contractual documents governing use of the Burbn platform. Where a conflict or inconsistency arises between this Policy and any other document in that set, the conflict shall be resolved by applying the following order of precedence, in descending order of authority:
- any separately signed written agreement between Burbn and the relevant party, but only for the programme it covers and only to the extent of the conflict
- the Terms of Service
- the Merchant Agreement, for matters concerning sellers
- the Creator Policy, for matters concerning creators
- the Privacy Policy and the Camera Effects and AR Lenses notice, for matters concerning personal data
- the Community Guidelines and Content Policy
- the Returns, Exchange and Refunds Policy, the Burbn Money Back Guarantee, the Shipping and Delivery Policy, and the Cookie Policy
- any other notice, help-centre article, dashboard text, or in-product copy
A document lower in this order does not narrow, qualify, or waive a right or obligation created by a document higher in it. Where a document lower in the order is silent on a matter addressed by a higher document, the higher document applies. Headings, summaries, and any explanatory text introduced by the words "Which means" are provided for readability only, do not form part of the operative terms, and do not limit the provisions they accompany.
No statement made in help-centre articles, dashboard copy, in-product text, marketing material, or by any employee or agent orally shall vary this Policy unless recorded in a written amendment published under the modification provisions of the Terms of Service.
19. Platform Role and Intermediary Status
Which means: Burbn runs the marketplace and the app. It does not manufacture, own, or sell the products listed on it, and it does not author the content users post.
Burbn operates as an intermediary within the meaning of the Information Technology Act, 2000 and as a marketplace e-commerce entity within the meaning of the Consumer Protection (E-Commerce) Rules, 2020. Burbn provides a technology platform that enables independent third-party sellers to list and sell goods, and enables users to publish content, communicate, and transact.
- Burbn does not manufacture, import, stock, own, inspect, or take title to any product listed on the platform, except where a listing expressly and prominently identifies Burbn as the seller of record. The contract of sale for every other listing is formed directly and exclusively between the buyer and the relevant seller.
- Burbn does not originate, select, author, commission, or modify user content, and does not exercise editorial control over it. Any moderation, ranking, recommendation, labelling, removal, or restriction undertaken by Burbn is performed voluntarily and in good faith to protect users and to comply with law, and shall not be construed as adoption of, endorsement of, or responsibility for that content, nor as conduct displacing the protection conferred by Section 79 of the Information Technology Act, 2000.
- Burbn observes the due diligence obligations applicable to intermediaries under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, including publication of these documents, operation of a grievance mechanism, and removal or disabling of access to unlawful information on receipt of actual knowledge in the form of a court order or a notification by an appropriate government agency.
- Nothing in this Policy creates any agency, partnership, joint venture, employment, franchise, or fiduciary relationship between Burbn and any seller, creator, logistics provider, payment provider, or user. No party may hold itself out as having authority to bind Burbn.
- Where Burbn assists a user in a dispute with a seller, processes a refund, arranges a pickup, or applies a service standard against a seller, it does so as an administrative facility for the orderly operation of the marketplace. Such assistance does not constitute an assumption of the seller's obligations, an admission of liability, or a warranty by Burbn in respect of the goods.
20. Disclaimer of Warranties
Which means: The platform is provided as it is. Burbn does not promise it will be uninterrupted, error-free, or fit for a particular purpose you have in mind.
THE PLATFORM, THE SERVICES, AND ALL CONTENT, FEATURES, TOOLS, ANALYTICS, ESTIMATES, RECOMMENDATIONS, AND INTEGRATIONS MADE AVAILABLE THROUGH THEM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OR CONDITION OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR ARISING FROM COURSE OF DEALING OR USAGE OF TRADE, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, OR NON-INFRINGEMENT.
Without limiting the generality of the foregoing, Burbn does not warrant that:
- the platform will be uninterrupted, timely, secure, or free from error, defect, or vulnerability;
- any defect, interruption, or vulnerability will be corrected within any particular period;
- the platform, or any server or infrastructure through which it is delivered, is free of malicious code;
- any result, outcome, reach, impression count, conversion, ranking, payout, revenue, saving, or commercial benefit will be achieved;
- any estimate, forecast, projection, delivery timeline, availability indication, price comparison, or analytics figure displayed on the platform is accurate, complete, or current;
- any content, listing, review, rating, claim, or representation published by a seller, creator, or other user is accurate, lawful, or reliable; or
- any third-party service, integration, logistics provider, payment provider, or technology provider will remain available or will perform as described.
Statistical, algorithmic, and machine-learning outputs — including recommendation ranking, search results, fraud signals, view validation, and content classification — are inherently probabilistic. They are provided as operational tools and not as statements of fact, and no warranty is given as to their accuracy in any individual case.
Nothing in this clause excludes or restricts any warranty, condition, guarantee, or right that cannot lawfully be excluded or restricted, including under the Consumer Protection Act, 2019. See the clause titled "Preservation of Statutory Rights" below.
21. Limitation of Liability
Which means: There is a ceiling on what Burbn can be made to pay, and Burbn is not liable for indirect losses such as lost profits. Some liabilities cannot be limited by law and are not limited here.
21.1 Exclusion of Indirect Loss
To the maximum extent permitted by applicable law, Burbn and its affiliates, directors, officers, employees, agents, licensors, vendors, and third party service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive loss or damage, nor for any loss of profit, loss of revenue, loss of anticipated saving, loss of business, loss of goodwill or reputation, loss of opportunity, loss of data, or cost of procuring substitute services, howsoever arising and whether in contract, tort including negligence, breach of statutory duty, restitution, or otherwise, and whether or not Burbn was advised of the possibility of such loss.
21.2 Aggregate Financial Cap
Subject to clause 21.4, the total aggregate liability of Burbn arising out of or in connection with this Policy, whether in contract, tort, breach of statutory duty, or otherwise, and whether in respect of one claim or a series of related claims, shall not exceed the greater of:
- the total amounts actually paid to Burbn by, or paid out by Burbn to, the Creator under this Policy in the 3 calendar months immediately preceding the first event giving rise to the claim; and
- INR 5,000 (Rupees Five Thousand).
The monetary floor at sub-clause (2) applies so that the cap can never evaluate to nil. A cap capable of evaluating to nil operates as an exclusion of liability rather than a limitation of it, and is accordingly stated here as a floor so that the clause remains a genuine limitation.
21.3 Matters Outside Burbn's Control
Burbn shall not be liable for loss or damage arising from:
- any defect in, safety of, description of, quality of, legality of, or non-conformity of any product supplied by a seller;
- any act, omission, delay, misconduct, insolvency, or breach by a seller, creator, buyer, logistics provider, payment provider, technology provider, or other third party;
- any content published by a user, including any reliance placed on it;
- loss, theft, damage, misdelivery, or delay occurring in transit;
- any unauthorised access to an account arising from a failure by the account holder to keep credentials secure;
- any suspension, restriction, or removal of content, listings, features, or accounts undertaken in accordance with these documents;
- any interruption, degradation, or unavailability of the platform, including during scheduled or emergency maintenance; or
- any event falling within the clause titled "Force Majeure" below.
21.4 Liabilities That Are Not Limited
Nothing in this Policy shall exclude or limit the liability of either party for:
- death or personal injury caused by that party’s negligence;
- fraud or fraudulent misrepresentation;
- wilful misconduct or gross negligence;
- any liability that cannot lawfully be excluded or limited under applicable law; or
- in the case of a seller or creator, the indemnity obligations owed to Burbn.
21.5 Basis of the Bargain and Allocation of Risk
Each party acknowledges that the exclusions and limitations in this clause are a reasonable and negotiated allocation of commercial risk, that they are reflected in the fees and commercial terms applicable between the parties, and that Burbn would not make the platform available on the same terms without them. Each sub-clause operates separately. If any sub-clause is held to be unenforceable in whole or in part, the remaining sub-clauses continue to apply.
This clause survives termination or expiry of this Policy and continues to protect Burbn in respect of claims relating to the period before termination.
22. Indemnity
Which means: If Burbn is sued or fined because of something the Creator did, the Creator covers the cost.
the Creator shall indemnify, defend, and hold harmless Burbn, its affiliates, and their respective directors, officers, employees, agents, licensors, vendors, and third party service providers from and against all claims, demands, proceedings, losses, liabilities, damages, fines, penalties, taxes, interest, awards, settlements, and costs, including reasonable legal fees and the internal cost of responding to regulatory or law-enforcement process, arising out of or in connection with:
- any breach of this Policy or of any other document in the Burbn policy set;
- any content, listing, claim, representation, review, advertisement, or communication published or made;
- any product supplied, including its defect, safety, labelling, description, packaging, warranty, or non-conformity;
- any infringement or misappropriation of intellectual property, publicity, privacy, or personality rights;
- any breach of applicable law, regulation, licence condition, or order of a court or authority;
- any misuse of personal data, including any failure to comply with obligations owed as a data fiduciary or data processor;
- any tax, duty, cess, or levy properly attributable to the indemnifying party, including any liability arising from an incorrect declaration of tax status or registration; and
- any act, omission, fraud, negligence, or misconduct of the indemnifying party or of its employees, agents, contractors, or representatives.
Burbn shall notify the indemnifying party of any claim for which indemnity is sought, without undue delay. Burbn may, at its option, assume or participate in the conduct of the defence of such claim using counsel of its choosing, and the indemnifying party shall not settle any claim in a manner that imposes any obligation, admission, or restriction on Burbn without Burbn's prior written consent. A failure or delay in notification does not relieve the indemnifying party except to the extent it is materially prejudiced by that failure.
Burbn may set off any amount due to it under this clause against any amount it holds for or owes to the indemnifying party, including payouts, balances, reserves, rewards, and refunds. This clause survives termination or expiry of this Policy.
23. Grievance Redressal and Statutory Contacts
Which means: There is a named officer whose job is to resolve complaints, with fixed deadlines. Use this route before litigation.
In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection Act, 2019, Burbn has designated the officers below. Complaints may be submitted in writing, in English or Hindi, and should identify the complainant, the content, order, listing, or account concerned, and the nature of the grievance.

23.2 Escalation
A complainant dissatisfied with the outcome may escalate to legal@scrolling.in. Complaints that are abusive, repetitive, manifestly unfounded, or made in bad faith may be closed with reasons. Submitting knowingly false information in a grievance, or a false takedown notice, may itself attract liability and may be relied upon by Burbn in proceedings.
24. Governing Law, Arbitration, and Jurisdiction
Which means: Indian law applies. Most disputes go to individual arbitration seated in Noida. The courts at Noida supervise.
this Policy is governed by and shall be construed in accordance with the laws of the Republic of India, without regard to any conflict of laws principle that would apply the law of another jurisdiction. For the avoidance of doubt, no law of any other state, province, territory, or country is intended to govern this Policy.
Any dispute, claim, or controversy arising out of or relating to this Policy, including as to its formation, existence, validity, interpretation, performance, breach, or termination, shall be resolved by final and binding arbitration on an individual basis in accordance with the arbitration provision at Section 17 of the Terms of Service, which is incorporated into this Policy by reference and applies as if set out in full here.
This agreement to arbitrate is between Scroll Inc., all of Scroll Inc.’s users, and all of Scroll Inc.’s vendors and third party service providers, including the providers of any underlying technology.
- Governing statute: the Arbitration and Conciliation Act, 1996.
- Seat of arbitration: Noida, Uttar Pradesh, India. The seat fixes the courts having supervisory jurisdiction over the arbitration.
- Venue of hearings: Noida, Uttar Pradesh, India, provided that hearings may be conducted by video conference or on documents alone where the parties agree or the arbitral tribunal so directs, so that participation is not unduly burdensome or expensive.
- Tribunal: a sole arbitrator, appointed by agreement failing which in accordance with the Arbitration and Conciliation Act, 1996.
- Language: English.
- Pre-arbitration step: a written notice of dispute followed by 30 days for good-faith resolution.
24.1 Interim and Urgent Relief
Notwithstanding the pre-arbitration step, either party may at any time apply to a competent court, or to the arbitral tribunal once constituted, for interim, interlocutory, injunctive, or other equitable relief, including to restrain infringement or misappropriation of intellectual property, breach of confidence, unauthorised access to data, or continuing unlawful conduct. Seeking such relief is not a waiver of the agreement to arbitrate and does not require the negotiation period to have elapsed. This preserves Burbn's ability to act immediately against an infringing listing or an ongoing safety risk.
24.2 Residual Jurisdiction
Where a dispute is not subject to arbitration, is excluded from arbitration, or where the agreement to arbitrate is held unenforceable in respect of a particular claim, the competent courts at Noida, Uttar Pradesh, India shall have exclusive jurisdiction over that claim, and each party irrevocably submits to that jurisdiction and waives any objection based on forum or inconvenience.
The United Nations Convention on Contracts for the International Sale of Goods does not apply and is expressly excluded. This clause survives termination or expiry of this Policy.
25. Preservation of Statutory Rights
Which means: Nothing in this document takes away a right the law gives you and does not let you sign away.
Nothing in this Policy operates to exclude, restrict, modify, or waive any right, remedy, guarantee, warranty, or protection conferred on a person by applicable law which cannot lawfully be excluded, restricted, modified, or waived, including under the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, the Digital Personal Data Protection Act, 2023, and the Indian Contract Act, 1872.
Where any provision of this Policy would, but for this clause, have that effect, the provision applies only to the extent permitted by law and is otherwise to be read down, or if it cannot be read down, severed, without affecting the remainder. In particular, a consumer's statutory right to seek redress before a consumer commission, and a data principal's right to approach the Data Protection Board, are preserved in full and are not displaced by the arbitration provision.
26. Force Majeure
Which means: Neither side is in breach for a failure caused by an event genuinely outside its control.
Neither party shall be liable for any failure or delay in performing an obligation under this Policy, other than an obligation to pay money already due, to the extent the failure or delay is caused by an event beyond that party's reasonable control, including act of God, flood, fire, earthquake, storm, epidemic or pandemic and any public-health measure taken in response, war, armed conflict, terrorism, riot, civil commotion, strike or other labour disturbance, act or order of any government or regulator, change in law, judicial order, embargo or sanction, failure or interruption of electricity, telecommunications, the internet, or any cloud, hosting, content-delivery, payment, or logistics provider, and any cyber attack, denial-of-service attack, or comparable malicious act.
The affected party shall notify the other without undue delay, shall use reasonable endeavours to mitigate, and shall resume performance as soon as reasonably practicable. Where such an event continues for more than sixty consecutive days, either party may terminate this Policy on written notice, without liability for the termination itself, and without prejudice to amounts already accrued.
27. Notices
Which means: How each side formally contacts the other, and when a notice counts as received.
Notices to Burbn must be in writing and sent to legal@scrolling.in and, where the notice commences or relates to legal proceedings, also by registered post or courier to Scroll Inc., 503, A1 Tower, Sector 73, Noida, Uttar Pradesh, India, marked for the attention of the Legal Department. Grievances under the clause titled "Grievance Redressal and Statutory Contacts" should instead be sent to grievance@scrolling.in.
Notices to the Creator may be given by email to the address registered on the account, by notification within the platform or the seller or creator dashboard, or by post to the address on record. It is the responsibility of the account holder to keep those details accurate and monitored.
A notice is deemed received: if sent by email, at the time of transmission, or if transmitted outside business hours, when business hours next resume; if given in-platform, on display to the recipient; and if sent by registered post or courier, on the third business day after despatch, or on proof of delivery, whichever is earlier. A notice sent to a stale, full, or unmonitored address recorded by the recipient is nonetheless validly given.
28. Electronic Record and Acceptance
Which means: This document is legally binding electronically. No physical signature is needed, and Burbn's records of your acceptance are evidence of it.
this Policy is an electronic record within the meaning of the Information Technology Act, 2000 and the rules made under it, and is a valid and enforceable contract formed by electronic means in accordance with Section 10A of the Information Technology Act, 2000. It does not require a physical or digital signature, seal, or stamp to be binding.
- Registration for an account, indication of acceptance through any interface element provided for that purpose, or continued access to or use of the platform, each constitutes full and unconditional acceptance of this Policy.
- Burbn maintains electronic records of acceptance, including identifiers, timestamps, document version, and the interface presented at the time. Each party agrees that such records, and any true copy or system-generated extract of them, are admissible and may be relied upon as evidence of acceptance in any arbitral or judicial proceeding, and waives any objection to admissibility founded solely on their electronic form.
- The version of this Policy in force at the time of the relevant act or omission governs that act or omission. Burbn retains superseded versions and will make the version applicable to a given date available on request to a party with a legitimate interest in it.
29. General Provisions
Which means: The standard machinery: what survives, what can be transferred, what happens if one clause fails.
29.1 Survival
Termination or expiry of this Policy does not affect any right, obligation, or liability that accrued before it. The clauses concerning intellectual property licences already granted, confidentiality, data protection, disclaimer of warranties, limitation of liability, indemnity, set-off and recovery, grievance redressal, governing law, arbitration and jurisdiction, notices, electronic records, and this clause survive termination and continue to bind both parties. The survival of the limitation of liability clause operates for the benefit of Burbn as well as of the Creator.
29.2 Severability
If any provision of this Policy is held invalid, illegal, or unenforceable by a court, tribunal, or competent authority, that provision shall first be read down to the minimum extent necessary to render it valid and enforceable while preserving the parties' commercial intent. Only if it cannot be read down shall it be severed, and severance shall not affect the validity or enforceability of the remainder.
29.3 No Waiver
A failure or delay in exercising a right under this Policy is not a waiver of that right, and a single or partial exercise does not preclude further exercise. A waiver is effective only if in writing and signed by an authorised representative of the waiving party, and applies only to the instance and purpose for which it is given. Burbn's forbearance in enforcing a provision against one person creates no expectation or entitlement in favour of any other.
29.4 Assignment
the Creator may not assign, transfer, charge, sub-contract, or otherwise deal with any right or obligation under this Policy without Burbn's prior written consent. Burbn may assign or transfer this Policy in whole or in part to an affiliate, or in connection with a merger, reorganisation, or sale of all or part of its business or assets, on notice and without consent. this Policy binds and benefits each party's permitted successors and assigns.
29.5 Third Party Rights
Except as expressly provided, no person who is not a party to this Policy has any right to enforce it. Burbn's affiliates, and the vendors and third party service providers identified as intended third-party beneficiaries in Section 17 of the Terms of Service, may enforce the clauses expressed to be for their benefit, including the disclaimer of warranties, the limitation of liability, the indemnity, and the agreement to arbitrate. No consent from any such person is required to amend or terminate this Policy.
29.6 Entire Agreement
this Policy, together with the other documents in the Burbn policy set and any separately signed agreement, constitutes the entire agreement between the parties on its subject matter and supersedes all prior representations, understandings, and arrangements, whether written or oral. For the avoidance of doubt, and notwithstanding anything to the contrary, this Policy does not exclude, supersede, or disapply any other document in the Burbn policy set; those documents apply together and are reconciled by the clause titled "Order of Precedence". Nothing in this clause limits liability for fraud or fraudulent misrepresentation.
29.7 Set-Off and Recovery
Burbn may set off, withhold, deduct, or recover any amount due to it or reasonably anticipated to become due to it under this Policy — including fees, commissions, penalties, refunds, chargebacks, reversals of incorrectly credited amounts, taxes, and indemnified sums — against any amount it holds for or owes to the Creator, including payouts, wallet balances, reserves, rewards, and incentives. Burbn will identify the basis of any set-off on request. Amounts remaining unrecovered are payable on demand and Burbn may pursue recovery through any lawful means.
29.8 Amendment
Burbn may amend this Policy. Where an amendment materially and adversely affects a party's rights, Burbn will give reasonable advance notice by email, in-platform notification, or publication, other than where an immediate change is required by law, regulatory direction, an order of a court or authority, or to address a security or safety risk, in which case the change takes effect on publication. Continued use after the effective date constitutes acceptance. A party that does not accept an amendment must cease using the platform and, where applicable, close its account before the effective date.
29.9 Language and Interpretation
The English text of this Policy prevails over any translation. The words "including", "includes", and "in particular" are illustrative and do not limit the generality of the words preceding them. A reference to a statute includes any amendment, re-enactment, or subordinate legislation made under it. The singular includes the plural. No rule of construction adverse to the drafter shall be applied by reason only of a document having been prepared by Burbn; each party has had the opportunity to obtain independent legal advice.
29.10 Compliance, Anti-Bribery, and Sanctions
Each party shall comply with all applicable anti-bribery, anti-corruption, anti-money-laundering, counter-terrorist-financing, and economic-sanctions laws, and shall not offer or accept any improper payment or advantage in connection with this Policy. Each party represents that it is not, and is not owned or controlled by, a person subject to applicable sanctions. Breach of this clause is a material breach entitling Burbn to suspend or terminate immediately.
